Welcome to MyPatientAssistant.com and its related software interfaces (collectively, the "Application"), operated by Patient Driven Care, Inc. ("we," "us," or "our"), a Texas corporation.
Please read these Terms of Service carefully before using our Application. They contain important information regarding your legal rights and limitations on our liability. By accessing or using any part of the Application, you agree to be bound by these Terms. If you do not agree to all of these Terms, you do not have permission to use or access our services.
Fees and Payments
We reserve the right to modify, change, or discontinue any services, features, or pricing tiers within the Application at any time without prior notice. All fees are displayed at the time of purchase and are exclusive of any applicable taxes, levies, or duties imposed by taxing authorities. We are not responsible for typographical errors, pricing glitches, or inaccuracies, and we reserve the right to cancel or refuse any order placed at an incorrect price.
Payment Processing
All financial transactions within the Application are handled by independent, third-party payment processors. We do not store, collect, or maintain your credit card or billing numbers on our servers. Any information you provide during a transaction is sent directly to the applicable third-party processor, and their use of your data is governed strictly by their own terms and privacy policies.
By initiating a purchase, you warrant that you possess the legal authority to use your selected payment method, and that all information you provide is accurate and complete. We accept whatever payment methods are supported by our third-party processors at the time of transaction, and we reserve the right to modify available payment options at any time. We assume no liability or responsibility for any errors, security incidents, data breaches, or processing failures that occur on or through the systems of our third-party payment processors.
Cancellations and Refunds
All purchases of services or digital products within the Application are final, completely non-cancelable by the user, and strictly non-refundable under any circumstances.
We reserve the absolute right, at our sole and independent discretion and without prior notice or liability, to refuse, limit, or cancel any transaction, order, or user access to the Application for any reason whatsoever, including but not limited to suspected fraud, unauthorized account activity, pricing inaccuracies, typographical errors, or service unavailability. The issuance of any refund, credit, or alternative remedy following a company-initiated cancellation remains at our sole, absolute, and exclusive discretion.
Subscriptions, Free Trials, and Automatic Renewals
We may offer access to the Application on a continuous, recurring subscription basis (e.g., monthly or annually). By activating a subscription, you authorize us (and our third-party payment processors) to automatically charge the applicable subscription fees to your designated payment method at the start of each renewal period, unless you cancel or we terminate your access.
Free Trials
We may, at our sole discretion, offer promotional free trials for specified durations. The exact terms, duration, and eligibility criteria for a free trial will be displayed at registration. If you do not cancel your trial before it expires, you will be automatically billed the full subscription fee for the subsequent billing cycle. We reserve the absolute right to modify, revoke, or cancel free trials at any time without notice or liability.
Cancellation and Access
You may cancel your subscription auto-renewal at any time through your account settings or by contacting us at contact@patientdrivencare.com. All cancellations take effect at the end of your current billing cycle; we do not offer prorated refunds, credits, or early revocations for partial terms. You will retain access to the paid features until the end of your current billing period, at which point your access will terminate.
Disclaimer of Warranties ("AS IS")
THE APPLICATION, AND ALL MATERIAL, FEATURES, DIGITAL PRODUCTS, AND SERVICES CONTAINED OR SOLD WITHIN IT, ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPLICITLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, QUIET ENJOYMENT, SYSTEM INTEGRATION, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APPLICATION WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, BE COMPLETELY SECURE, DETECT ALL DATA ACCURATELY, OR BE ENTIRELY ERROR-FREE. YOUR USE OF THE APPLICATION AND ANY PURCHASES MADE THROUGH IT ARE AT YOUR OWN INDEPENDENT RISK.
Account Registration and Security
To utilize certain features of the Application, you must register and maintain an active user account. By creating an account, you represent and warrant that you are at least 18 years of age and that all information you provide to us is accurate, current, and complete.
Credential Responsibility
You are solely and entirely responsible for maintaining the confidentiality of your account credentials, passwords, and access restrictions on your devices. You accept full legal and financial responsibility for any and all activities, actions, or transactions that occur under your account, whether authorized by you or not. You must notify us immediately at contact@patientdrivencare.com upon discovering any unauthorized use, security breach, or compromise of your account.
Termination of Access
We reserve the absolute, unconditional right, at our sole and exclusive discretion, to suspend, limit, restrict, or permanently terminate your account and your access to the Application at any time, for any reason or no reason whatsoever, without prior notice, explanation, or liability to you. You may request the deletion of your account at any time through the Application's settings or by contacting us directly.
Health Data Integration and Connection Controls
Patient Driven Care, Inc. partners with b.well Connected Health, Inc., a trusted health data intermediary, to securely connect your health information. When you authorize data connections, you consent to b.well accessing your health records using your credentials and providing them to Patient Driven Care, Inc. for purposes consistent with our Terms and Privacy Policy. You also authorize Patient Driven Care, Inc. to share information from your account with b.well as needed to maintain these connections. When connecting to patient portals, you confirm you are using your own credentials. You can disconnect any source or delete data from specific sources at any time by utilizing the designated data management or account connection settings provided within the Application, or by contacting us at contact@patientdrivencare.com. Disconnecting stops future data collection but does not affect information already provided to Patient Driven Care, Inc., though you can separately request deletion of such data. Patient Driven Care, Inc. will not use or sell your health data for marketing purposes without your separate, explicit consent.
User Content, Proxy Relationships, and AI Features
1. User Content and Processing License
You retain all ownership rights to any text, notes, medical documents, prompts, or communication logs you upload or generate within the Application (collectively, "User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process this data solely to operate the Application, facilitate authorized multi-account sharing, power our internal AI features, and execute user-requested functionalities.
2. Multi-Account and Caregiver Relationships (Proxy Access)
The Application allows for distinct account relationships, including parents managing minor dependents, and adult caregivers managing elderly family members.
- Authority Warranty: If you access, input data into, or manage an account on behalf of anyone else (minor or adult), you represent and warrant that you possess the full, unconditioned legal authority to do so, whether through parental rights, a valid Power of Attorney, or explicit, documented adult consent.
- Shared Liability: We assume zero liability for data visibility, note-sharing, or setting modifications that occur between linked accounts. If a caregiver inputs incorrect notes, flips a switch, or modifies settings within a linked account, you agree that this is an independent action between the users, and we are not responsible for any resulting errors or real-world consequences.
3. AI Assistant and Automated Actions
The Application utilizes internal Large Language Models (LLMs) to analyze documents, answer questions, and perform automated tasks or toggle configurations within your account based on your prompts.
- NOT MEDICAL ADVICE: You explicitly acknowledge that any outputs, summaries, or responses generated by the AI assistant are for informational and organizational coordination purposes only. The AI does not provide medical advice, diagnoses, or treatment plans.
- User Verification Required: If you instruct the AI assistant to take an action, toggle a feature, or configure a setting within the Application, you are entirely responsible for verifying that the action was executed correctly. We are not liable for any system glitches, algorithmic hallucinations, or software misconfigurations resulting from AI-driven prompts.
4. Prohibited Conduct
You agree not to exploit the free-form text fields, document uploads, or AI prompts to disrupt the platform. We reserve the absolute right to delete content or ban accounts at our sole discretion if any user engages in conduct that is unlawful, uploads unauthorized third-party data, executes automated data scraping, deploys malware, or attempts prompt injection attacks or reverse-engineering of our artificial intelligence models.
Limitation of Liability and Third-Party Links
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PATIENT DRIVEN CARE, INC., ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE APPLICATION.
UNDER NO CIRCUMSTANCES WILL PATIENT DRIVEN CARE, INC. BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, SYSTEM GLITCHES, AI CONVERSATION ERRORS, OR OTHER UNAUTHORIZED ACCESS OR USE OF YOUR ACCOUNT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS IS STRICTLY LIMITED TO THE GREATER OF THE TOTAL FEES ACTUALLY PAID BY YOU TO PATIENT DRIVEN CARE, INC. WITHIN THE ACCRUED REVENUE PERIOD FOR YOUR SUBSCRIPTION, OR TEN DOLLARS ($10.00).

The Application contains links to external healthcare portals, insurance providers, and third-party web platforms. We do not own, control, vet, or assume any legal liability for the content, privacy policies, practices, or security protocols of any third-party websites or services. You access external links entirely at your own independent risk.
Intellectual Property Rights
The Application, along with its original code, user interfaces, visual designs, graphics, text, data structures, proprietary algorithms, and internal artificial intelligence configurations (collectively, the "Company IP"), are the exclusive property of Patient Driven Care, Inc. and its licensors.
You are granted a limited, non-transferable, revocable license to access the Application strictly for personal, non-commercial use as an authorized user or caregiver. You may not copy, modify, scrape, distribute, reverse-engineer, or create derivative works of our Company IP without our explicit, prior written authorization. If you believe any content within the Application infringes upon your personal copyright or intellectual property, please report the details immediately to contact@patientdrivencare.com.
Governing Law, Venue, and Class Action Waiver
These Terms and any disputes arising out of your use of the Application shall be governed exclusively by the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Mandatory Venue
Any legal action, suit, or proceeding arising out of or relating to these Terms must be brought exclusively in a court of competent jurisdiction located in Denton County, Texas, and you explicitly consent to the personal jurisdiction of such courts.
Class Action Waiver
YOU AND PATIENT DRIVEN CARE, INC. AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. COURTS DO NOT HAVE THE AUTHORITY TO CONSOLIDATE MULTIPLE USER CLAIMS INTO A SINGLE LAWSUIT.
Changes to Terms of Service
We reserve the right to modify or update these Terms of Service at any time. When updates are made, we will revise the "Last Updated" date at the top of this page. For any material changes that substantially alter your legal rights or obligations, we may notify you through a prominent notice within the Application or via email. Your continued use of or access to the Application following the posting of any changes constitutes binding acceptance of those modifications. If you do not agree to the revised Terms, your sole remedy is to discontinue use of the Application.
